Terms of Service
Effective date: 1 July 2025
1. Acceptance of Terms
By creating an account or using the Prestige mobile app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
You must be 18 years or older and legally capable of entering a binding contract in Australia.
3. Account Registration & Security
• Accounts are created on our website and accessed via secure login in the App.
• You are responsible for safeguarding your login credentials.
• You must notify us immediately of unauthorised use.
4. Subscriptions & Billing
Price: AUD $20/month (inclusive of GST).
Billing: Handled by Stripe; charged monthly until cancelled.
Cancellation: Log in to the web portal → Manage Subscription. Access to rewards ends at the next billing cycle.
Refunds: Contact bookings@prestigeluxuryrentals.com.au within 14 days of charge. Refunds are discretionary and may take 7 business days to process.
5. Rewards Programme
Membership grants access to discounts on vehicle bookings and other Prestige experiences. Full rules are outlined in-app and may change occasionally. Rewards have no cash value.
6. Bookings & Vehicle Rental
The App is a booking interface only. All vehicle collection, driving eligibility checks (licence, security deposit, insurance) and rental contracts are completed in person under separate rental terms provided at pickup.
7. Acceptable Use
You agree not to:
• break or attempt to break the App's security;
• use another person's account without permission;
• post or transmit malicious code;
• scrape, copy or reverse-engineer any part of the App.
8. Intellectual Property
All content in the App—including logos, text and images—is owned by Prestige or its licensors. You receive a limited, non-exclusive, revocable licence to use the App for personal, non-commercial purposes.
9. Disclaimer & Limitation of Liability
The App is provided as is without warranties of any kind. To the maximum extent permitted by law:
• We exclude all implied warranties.
• Our total liability for any claim arising out of or in connection with the App will not exceed AUD $100.
Nothing in these Terms limits liability for death, personal injury, gross negligence or any liability that cannot be excluded under Australian Consumer Law.
10. Indemnity
You agree to indemnify and hold Prestige harmless from any claims, damages or expenses arising from your breach of these Terms or misuse of the App.
11. Termination
We may suspend or terminate your account immediately if you:
• breach these Terms;
• fail to pay fees; or
• engage in fraudulent or harmful conduct.
You may terminate at any time via the web portal. Sections 8-12 survive termination.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
13. Changes to Terms
We may modify these Terms by posting an updated version in the App and emailing you at least 14 days in advance. Continued use after that date constitutes acceptance.
